INTRODUCTION

We recognize the importance of protecting the corporate information you provide to the Audio Publishers Association (the “APA”, “us”, “our”).

This policy outlines the information the APA collects, how it uses, maintains, and protects the information and how you can control the information you provide when you visit the website www.audiopub.org (our “Site”).

This policy applies to information we collect:

  • On this Site.

  • In email, text, and other electronic messages between you and this Site.

  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by us or any third party (including our affiliates and subsidiaries); or

  • any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Site.

INTERNATIONAL PRIVACY LAWS

Our Site is operated in the United States and intended for users located in the United States, although your information may be transferred to - and maintained on - computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. CHILDREN UNDER THE AGE OF 13

Our Site is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Site or on or through any of its features, register for a membership on the Site, make any purchases through the Site, use any of the interactive or public comment features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we dispose of that information in accordance with the Children’s Online Privacy Protection Act of 1998. If a parent or guardian becomes aware that their child has provided us with personal information with the parent’s or guardian’s consent, such parent or guardian should contact us at info@audiopub.org.

INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We collect several types of information from and about users of our Site, including information:

  • that you provide directly on the Site by which you may be personally identified, such as name, personal and/or business address, e-mail address, telephone and/or fax number, credit card information, password, login credentials, demographic information, or any other identifier by which you may be contacted online or offline (“personal information”);

This includes information provided at the time of registering to use our Site, purchasing a membership through our Site, subscribing to our services, posting material, or requesting further services. We may also ask you for information when you report a problem with our Site.

  • Records and copies of your correspondence (including email addresses), if you contact us.

  • Your responses to surveys that we might ask you to complete for research purposes.

  • Details of transactions you carry out through our Site and of the fulfillment of your requests. You may be required to provide financial information before placing an order through our Site.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Site, or transmitted to other users of the Site or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

INFORMATION WE COLLECT THROUGH AUTOMATIC DATA COLLECTION TECHNOLOGIES

Our Site does not track its users across third party websites, nor does it allow third parties to collect personal information thereon. HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Site and its contents to you.

  • To provide you with information, products, or services that you request from us.

  • To maintain and digitally publish our membership directory.

  • To provide you with notices of upcoming events and programs.

  • To publish attendee registration lists for APA-sponsored events including the Audio Publishers Association Conference (APAC), Audies Gala, Webinars, and Socials.

  • To fulfill any other purpose for which you provide it.

  • To provide you with notices about your account/subscription, including expiration and renewal notices.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To notify you about changes to our Site or any products or services we offer or provide though it.

  • To allow you to participate in interactive features on our Site.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

DISCLOSURE OF YOUR INFORMATION

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Site users is among the assets transferred.

  • To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our Site, we will transmit the contents of that email and your email address to the recipients.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

  • Promotional Offers from the Association. If you do not wish to have your email address or contact information used by the Association to promote our own or third parties’ products or services, you can opt-out by unsubscribing from our emails by clicking the link contained therein or by sending us an email to info@audiopub.org stating your request to have your contact information removed. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Association as a result of a product purchase, warranty registration, product service experience or other transactions.

California residents may have additional personal information rights and choices. Please see "Your California Privacy Rights" for more information.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: info@audiopub.org. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

ACCESSING AND CORRECTING YOUR INFORMATION

You can review and change your personal information by logging into the Site and visiting your account profile page.

You may also send us an email at info@audiopub.org to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Site, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Site users. Proper access and use of information provided on the Site, including User Contributions, is governed by our Terms of Use, found at https://www.audiopub.org/terms-of-use.

YOUR CALIFORNIA PRIVACY RIGHTS

Effective January 1, 2020, the California Consumer Privacy Act (“CCPA”) allows California residents twice a year, upon a verifiable consumer request, to request that a business that collects consumers’ personal information to give consumers access, in a portable and (if technically feasible) readily usable form, to the specific pieces and categories of personal information that the business has collected about the consumer, the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared. California residents also have the right to submit a request for deletion of information under certain circumstances. Consistent with California law, if you choose to exercise your rights, we won’t charge you different prices or provide different quality of services unless those differences are related to your information. Send an email to info@audiopub.org to make such a request. Please note that you must verify your identity before we take any action in response to such a request. As a part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification. We endeavor to respond to a verifiable consumer request within 45 days of its receipt. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not sell personal information to third parties. We do allow third parties to collect personal information through our Services and share personal information with third parties for the business purposes described in this Privacy Policy, including without limitation advertising and marketing on our Service and elsewhere based on users’ online activities over time and across different sites, services, and devices.

DATA SECURITY

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

CHANGES TO OUR PRIVACY POLICY

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Site home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this privacy policy to check for any changes.
